Terms of Service

These Terms of Service ("Terms") govern your access to and use of Rattlesnake Picks ("Service," "we," "us," or "our"), operated at rattlesnakepicks.com. By creating an account or using the Service, you agree to be bound by these Terms in their entirety. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally permitted to engage in event-based trading in your jurisdiction. You are solely responsible for ensuring your use of the Service complies with all applicable local, state, and federal laws.

2. Description of Service

Rattlesnake Picks is an automated sports trading software platform. The Service connects to your third-party trading account (e.g., Kalshi) via API credentials you provide and executes trades based on quantitative models and parameters you configure. We are a software tool only.

3. Not Financial Advice

The Service does not constitute financial advice, investment advice, trading advice, or any other form of professional advice. No content, data, analysis, trade signal, or output provided by Rattlesnake Picks should be interpreted as a recommendation to buy, sell, or hold any position. You should consult a qualified financial advisor before making any financial decisions.

4. No Guarantee of Results

We make no guarantees, representations, or warranties regarding trading performance, profitability, or returns. Specifically:

• Past performance displayed on the platform is not indicative of future results.
• All trading involves substantial risk of financial loss, including the possibility of losing your entire account balance.
• Our quantitative models may produce losses, and there is no assurance that the models will be profitable over any period.
• Market conditions, data availability, API reliability, and other factors outside our control may impact trade execution and outcomes.
• Historical performance metrics, win rates, and P&L figures shown on the platform are for informational purposes only and should not be relied upon as predictors of future performance.

5. Assumption of Risk

You expressly acknowledge and agree that you use the Service entirely at your own risk. By using the Service, you understand that:

• You may lose some or all of the funds in your connected trading account.
• You are solely responsible for all trades executed through your account, whether initiated manually or automatically by the Service.
• You have the financial capacity to bear any losses incurred through use of the Service.
• You have independently evaluated the risks of automated trading and determined that it is appropriate for your circumstances.

6. Your Account and API Credentials

• You are responsible for maintaining the confidentiality of your account credentials and API keys.
• Your API keys are encrypted at rest using industry-standard encryption (Fernet/AES). We do not store plaintext API keys.
• You may revoke your API credentials at any time through your trading platform (e.g., Kalshi) to immediately stop automated trading.
• You are responsible for configuring appropriate risk parameters (stop loss, trade caps, daily limits) and monitoring your account.

7. Subscription and Billing

• The Service offers a free trial period. After the trial, continued access requires a paid subscription.
• Subscription fees are billed in advance on a monthly basis and are non-refundable.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. No partial refunds will be issued.

8. Refund Policy

All subscription payments are final and non-refundable. Because the Service provides immediate access to automated trading tools and proprietary model outputs upon payment, refunds are not available under any circumstances, including but not limited to:

• Trading losses incurred while using the Service.
• Dissatisfaction with trading performance or model accuracy.
• Technical issues with third-party platforms (e.g., Kalshi API outages).
• Failure to cancel before a billing cycle renewal.
• Changes in applicable laws or regulations affecting your ability to trade.

We encourage users to fully evaluate the Service during the free trial period before subscribing.

9. Service Availability

We strive to maintain uptime but do not guarantee uninterrupted, error-free, or continuous access to the Service. We are not liable for any losses resulting from downtime, technical failures, delays in trade execution, API errors, or any other service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Rattlesnake Picks, its owners, operators, affiliates, and employees shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from:

• Your use of or inability to use the Service.
• Any trades executed or not executed through the Service.
• Any financial losses, including loss of profits, trading capital, or anticipated gains.
• Errors, inaccuracies, or omissions in data, models, or trade signals.
• Unauthorized access to your account or API credentials.
• Any third-party actions, including but not limited to Kalshi platform issues.

In no event shall our total liability exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Rattlesnake Picks and its owners, operators, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any applicable law.

12. Intellectual Property

All content, models, algorithms, software, and materials provided through the Service are the proprietary property of Rattlesnake Picks. You may not copy, reverse engineer, distribute, or create derivative works from any part of the Service.

13. Prohibited Use

You agree not to:

• Share, resell, or redistribute access to your account or the Service.
• Attempt to reverse engineer, decompile, or extract our models or algorithms.
• Use the Service for any unlawful purpose.
• Interfere with or disrupt the Service or its infrastructure.
• Create multiple accounts to abuse trial periods or promotions.

14. Termination

We may suspend or terminate your account at our sole discretion, with or without notice, for any reason including violation of these Terms. Upon termination, your right to access the Service ceases immediately. No refund will be issued upon termination.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Rattlesnake Picks regarding the Service.
